Thank you for the response.

The seller's agent stated that if I do not feel comfortable writing a check to the seller, then I can write a checkk to him instead.

My agent said that I can do this b/c i'd be protected and have piece of mind that the seller is acting within his license as a broker...so i would not be at risk for losing that money.

But it still seems shady to me. What assurance do I know that the monies will be paid within escrow...and that the agent doesnt take my money and run...or the agent doesn't just turn around and write a check to the seller to get this deal done?

Tell him you'll give him the check right after closing. Or that you will write the check to escrow. Either way you will be protected. Ask him why this is not going through escrow. Obviously, it is because the lender wont' allow it. How does he justify trying to deceive them?

You say this agent is a broker. If his license is held by another broker, like a large real estate firm, call his broker and ask if he approves of the tactics this agent is using. You didn't say where you live, but around here what he is doing is fraud.
