Seller breaking contract

We had a contract with a seller and were in the process of purchasing unimproved land. The lender and title company were not able to get everything together by the first closing date, but the broker said it would be no problem to have the date extended. We signed an amended contract to have the closing date extended 5 days. By this time we had already paid for the appraisal and the Water Well inspection. Two days before we were to close, the seller decides he wants to pull out because he's found someone who will pay his original asking price (though he did offer to sell to us if we paid the appraised price). He is releasing the earnest money to us, but is there any way to get him to pay for the other monies we invested into making this purchase (the Well inspection fee and appraisal fee - total $400)?
